Essential points when considering the storage period for recordings are data economy and the legal regulations for this.
Decisive for this is § 6b paragraph 5 BDSG
"The data must be deleted immediately if they are no longer required to achieve the purpose for which they were collected or if further storage conflicts with the interests of the persons concerned that are worthy of protection".
In Austria there is a fixed maximum recording time of 72 hours.
In Germany, according to the supervisory authorities, a recording may be stored for a maximum of 72 hours. However, as this is not always practicable - for example, there may be no working hours at the weekend and a long weekend. Then video recordings would already be deleted before they can be analysed.
For this reason there are already court decisions in Germany (e.g. by the OVG Lüneburg) that a longer storage period of up to 10 days in non-working hours is possible.
It is important that the recording duration is justified exactly.
